This end-payor antitrust settlement resolves claims that Teva used reformulations and improper patent listings to delay generic competition for the QVAR and QVAR RediHaler asthma inhalers, keeping prices inflated. The $35 million fund covers consumers and third-party payors (insurers, union benefit funds, employer health plans) that purchased, paid for or were reimbursed for QVAR products between January 2015 and July 2025 in 41 states plus D.C. Purchase documentation earns a larger share. The claim deadline is July 31, 2026, with final approval August 5, 2026. What you can claim: a pro-rata share of the consumer fund, which is 20.7% of the $35 million settlement after costs (third-party payors split the other 79.3%). There is no flat payment and no cap: what you get depends on how many QVAR or QVAR RediHaler prescriptions you paid for, what you paid out of pocket, and how many other people claim. The administrator says plainly that "it is unknown how much each individual consumer or TPP who submits a valid claim will receive." The claim form asks for your total prescriptions and total out-of-pocket spend, and you must upload something backing it up — pharmacy or insurer records, an EOB, a doctor's note, or receipts. The form also has an "Agent/Legal Representative" field, so someone may sign it for you.

Who is eligible?

• You purchased, paid for, or were reimbursed for QVAR or QVAR RediHaler inhalers between January 1, 2015 and July 31, 2025.
• Your purchase was in one of the 41 covered states or D.C.
• Both individual consumers and third-party payors (insurers, benefit funds, health plans) qualify.
